Article III.5(a)

Article III.5(a) provides for three different sources of responsibilities for Bosnia and Herzegovina. It stipulates indeed that Bosnia and Herzegovina shall assume responsibility for such other matters (1) as are agreed by the Entities;

(2) as are provided for in Annexes 5 through 8 to the General Framework Agreement; or (3) as are necessary to preserve the sovereignty, territorial integrity, political independence, and international personality of Bosnia and Herzegovina. The Court observed that Article III.5(a) distinguishes between “three mutually independent hypotheses”.²⁶³⁸ This section will address each source of responsibilities in turn.
