Derogation from obligations under the International Covenant on Civil and Political Rights in an emergency must not involve discrimination solely on the ground of race, colour, sex, language, religion or social origin2233 and differential treatment that has no objective and reasonable justification is unlikely to be regarded as lawful for the purpose of derogations under the ECHR, the European Social Charter and the European Social Charter (Revised)2234 where it is for a prohibited ground.
