The BiH Constitutional Court did not establish that there was a property within the meaning of Article 1 of Additional Protocol No. 1 to the ECHR in the following cases:<\/p>\n

\u25a0 donation <\/i>for reconstruction of a house, if there is no right to it but a decision is at the discretion of the administrative authority;1855<\/sup><\/span><\/p>\n

\u25a0 expropriated property<\/i>;1856<\/sup><\/span><\/p>\n

\u25a0 confiscated property<\/i>;1857<\/sup><\/span><\/p>\n

\u25a0 nationalised property<\/i>;1858<\/sup><\/span><\/p>\n

\u25a0 compensation for damages <\/i>in the case of dissolution of marriage concluded according to Shariat (the so-called mahr);1859<\/sup><\/span><\/p>\n

\u25a0 compensation for damage caused to property during the war if the alleged responsible person is not sued<\/i>;1860<\/sup><\/span><\/p>\n

\u25a0 offer in the privatisation process<\/i>1861 <\/sup><\/span>or auction<\/i>;1862<\/sup><\/span><\/p>\n

\u25a0 taxes on revenue, sales tax<\/i>;1863<\/sup><\/span><\/p>\n

\u25a0 right to restitution in accordance with a law supposed to be adopted<\/i>;1864<\/sup><\/span><\/p>\n

\u25a0 priority right to purchase <\/i>in the case of division of property according to the ownership portions;1865<\/sup><\/span><\/p>\n

\u25a0 precarious contract<\/i>1866<\/sup><\/span><\/p>\n

\u25a0 list on the allocation of apartments: <\/i>being put on the apartment allocation list (based on which socially owned apartments used to be allocated); the procedure for assessment of the candidate\u2019s eligibility for putting him\/her on the list;1867 <\/sup><\/span>request to declare the apartment allocation list null;1868<\/sup><\/span><\/p>\n

\u25a0 costs of utilities: garbage collection fee<\/i>;1869<\/sup><\/span><\/p>\n

\u25a0 meal allowance <\/i>off duty;1870<\/sup><\/span><\/p>\n

\u25a0 ownership and other property rights whose acquisition is at the discretion of administrative authorities <\/i>(expectations of acquiring a land;1871 <\/sup><\/span>the employees\u2019 expectations of acquiring shares in a company in the privatisation process;1872 <\/sup><\/span>the expectations of a JNA member who had an occupancy right that he would conclude a contract on the apartment purchase1873<\/sup><\/span>);<\/p>\n

\u25a0 ownership and other property rights which the appellant could not prove during the proceedings <\/i>(ownership;1874 <\/sup><\/span>compensation for expropriation;1875 <\/sup><\/span>a priority right to purchase a land, which ceased to exist;1876 <\/sup><\/span>the rights under the purchase pre-contract;1877 <\/sup><\/span>occupancy right;1878 <\/sup><\/span>heritage;1879 <\/sup><\/span>claim for damages;1880 <\/sup><\/span>claim for compensation for damages caused by inflation or denomination1881<\/sup><\/span>; compensation for military service;1882 <\/sup><\/span>pension;1883 <\/sup><\/span>compensation for performed work1884<\/sup><\/span>);<\/p>\n

\u25a0 ownership and other property rights exercised without legal basis<\/i>;1885 <\/sup><\/span>however, unlawfully acquired ownership1886 <\/sup><\/span>or lease,1887 <\/sup><\/span>fall under the scope of application1888 <\/sup><\/span>if the unlawfulness is based on an act of the competent authority, its failure to act or declaration;<\/p>\n
