{"id":12015,"date":"2024-12-09T12:10:24","date_gmt":"2024-12-09T11:10:24","guid":{"rendered":""},"modified":"2024-12-09T16:39:18","modified_gmt":"2024-12-09T15:39:18","slug":"a-summary-of-basic-principles","status":"publish","type":"page","link":"https:\/\/ustavbih.ba\/en\/article-ii-human-rights-and-fundamental-freedoms\/c-obligation-to-directly-apply-the-echr-article-ii-2-of-the-bih-constitution\/protection-of-property-article-1-of-additional-protocol-no-1-to-the-echr\/the-scope-of-protection\/a-summary-of-basic-principles\/","title":{"rendered":"A summary of basic principles"},"content":{"rendered":"<p class=\"p1\">Article 1 of Additional Protocol No. 1 to the ECHR and Article II.3(k) of the BiH Constitution protect only the existing ownership and similar legal status although in principle they do not protect the right to acquire a property.<span class=\"s1\"><sup>1761 <\/sup><\/span>However, Article 1 of Additional Protocol No. 1 to the ECHR includes \u201clegitimate expectations\u201d to acquire a property if they are based on an applicable administrative act or administrative legal regulations.<span class=\"s1\"><sup>1762 <\/sup><\/span>Therefore, the \u201clegitimate expectations\u201d mean that a person can prove that he\/she is entitled to the proprietary legal status he\/she claims based on a legal act. The term \u201cproperty\u201d includes a wide range of proprietary interests representing an economic value.<span class=\"s1\"><sup>1763 <\/sup><\/span>This term should not be interpreted in a restrictive manner. Moreover, the notion of ownership includes all property rights which represent an economic value<span class=\"s1\"><sup>1764 <\/sup><\/span>even if they are not classified as civil rights<span class=\"s1\"><sup>1765 <\/sup><\/span>according to the national legislation or ownership rights.<span class=\"s1\"><sup>1766 <\/sup><\/span>A temporary right which has an economic value can constitute property within the meaning of Article 1 of Additional Protocol No. 1 to the ECHR.<span class=\"s1\"><sup>1767 <\/sup><\/span>However, socially owned property allocated for use does not constitute property.<span class=\"s1\"><sup>1768 <\/sup><\/span>Both the legal position in rem and legal position in personam can be considered as property within the meaning of Article 1 of Additional Protocol No.1 to the ECHR even if there is a lack of clarity relating to its existence.<span class=\"s1\"><sup>1769 <\/sup><\/span>As to the in rem legal position, in order for a right to fall under the scope of protection, it may be necessary to prove the existence of just title (iustus titiulus), or the ownership should be based on the permanent indisputable possession and use.<span class=\"s1\"><sup>1770<\/sup><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Article 1 of Additional Protocol No. 1 to the ECHR and Article II.3(k) of the BiH Constitution protect only the existing ownership and similar legal status although in principle they do not protect the right to acquire a property.1761 However, Article 1 of Additional Protocol No. 1 to the ECHR includes \u201clegitimate expectations\u201d to acquire &hellip;
